SHIPPING POLICY

Fast Media Pvt Ltd. (herein referred to as “Quizkart”, “we”, “us”, “our”) hosts/operates campaigns on its website https://www.quizkart.com/ and through its mobile application (collectively referred to as “Portal”). This Shipping Policy (“Policy”) is a part of the Terms and Conditions along with all the rules and regulations stated therein which shall apply to the Users (herein referred to as “you”, “your”) of the Portal. By registering or browsing or downloading or using or accessing any part of the Portal or utilizing the services rendered by Quizkart, you will be legally bound by this Policy. If you do not agree with any of the terms of the Policy, you can refrain from accessing or using the Portal. 

  1. Communications 
  1. When you use the Portal or send emails or other data, information, or communication to us, you agree and understand that you are communicating with us through electronic records and you consent to receive communications via electronic records from us periodically. We may communicate with you by SMS (including transactional, promotional, and/or commercial messages), email, or by such other mode of communication, electronic or otherwise.  

 

  1. Purchases and prizes  
  1.  User shall be offered coupons / vouchers /product reward/cash reward (“Loot Deal”) upon payment of the entry fee (“Campaign Participation Fee”) depending on the campaign chosen by the User with a subsequent opportunity to win the Bumper Prize associated with the relevant campaign. 

 

  1. Once the Loot Deal is offered upon the payment of the Campaign Participation Fee, any request for cancellations or replacement of coupons duly placed on the Portal shall not be accepted. 

 

  1. The distribution of the Bumper Prize between the winners will be decided by Quizkart and may vary depending upon the campaign. The decision of Quizkart with respect to the awarding of Bumper Prizes shall be final, binding, non-negotiable and non-contestable. 

 

  1. All Loot Deals and/or Bumper Prizes shall be subject to deduction of tax as per the Income Tax Act 1961 and Goods and Services Act 2017 in accordance with the current prevailing rate (if applicable) on the Loot Deals and/or Bumper Prize and subject to further revisions by the Government of India as applicable from time to time. Winners will be provided certificates in respect of such tax deductions. The winners shall be responsible for payment of any other applicable taxes, including but not limited to, GST, income tax, gift tax, etc. in respect of the Loot Deals and/or Bumper Prize. 

 

  1. Shipping  
  1.  Details related to Loot Deals and/or Bumper Prize will be sent to the registered email address of the User and the User should ensure all the details are accurate. Quizkart upon verifying the claims will provide instructions via the User’s registered email regarding the details for redeeming the Loot Deal and/or Bumper Prize directly from the third party associated with it. 

 

  1.  Quizkart is not responsible for the delivery or shipping of the Loot Deal and/or Bumper Prize. Quizkart will communicate to the User regarding the procedure for claiming the Loot Deal and/or Bumper Prize. The logistics and modalities of the same varies and depends on a case to case basis in accordance with the terms and conditions of the third party vendor. Shipping of Loot Deals and/or Bumper Prize will only be to the Indian address as specified by the User.     

 

  1.  All logistics regarding shipping charges, cancellation, replacement, exchange, warranty, defective product, return, delay in delivery, packaging and other details regarding the Loot Deal and/or Bumper Prize shall be in accordance with the terms and conditions of the relevant third party associated with the Loot Deal and/or Bumper Prize and Quizkart is not responsible for the same.    

 

  1. Third Party Service Provider 
  1.  Quizkart has entered into contracts and tied up with various brands and suppliers who will be responsible for delivery of Loot Deal and/or Bumper Prize. The terms and conditions of the relevant third party is applicable after verification of the Loot Deal and/or Bumper Prize claim by Quizkart.  

 

  1.  The User must understand the terms and conditions of the respective third party’s website with regard to the Loot Deal and/or Bumper Prize. Quizkart shall not be answerable for any claims arising out of such Loot Deal and/or Bumper Prize provided by the third party.  

 

  1.  User’s correspondence, transactions/offers or related activities with third parties including payment providers are solely between the User and that third party providing such Loot Deal and/or Bumper Prize.  

 

  1.  Any questions, complaints, or claims related to any third-party product or service should be directed to the appropriate third party. 

 

  1. Disclaimer of Warranties and Liability 
  1.  On the Portal, all the services made available to you are provided on an “as is” and “as available” basis without any representation or warranties, express or implied except otherwise specified in writing by Quizkart. 

 

  1. Quizkart will not bear any responsibility for the transportation or packaging of Loot Deal and/or Bumper Prize to the respective winners or Users and for any loss or damage caused to any Loot Deal and/or Bumper Prize thereof or for any deficiency in availing the service reward. 

 

  1. Quizkart makes no representations or warranties as to the quality, suitability or merchantability of any Loot Deal and/or Bumper Prize and shall not be liable in respect of the same. 

 

  1. Quizkart may, at its sole and absolute discretion, vary or modify the Loot Deal and/or Bumper Prize being offered to winners. User shall not raise any claim against Quizkart or question its right to modify such Loot Deal and/or Bumper Prize being offered, prior to closure of the campaign(s).  

 

  1. Quizkart accepts no liability, whether jointly or severally, for any errors or omissions, either on behalf of itself or third parties in relation to the Loot Deal and/or Bumper Prize. 

 

  1.  Loot Deal and/or Bumper Prize are generally intended for normal domestic and consumer use and not for resale or commercial use.  

 

  1.  Quizkart shall not be liable for any delay / non-delivery of Loot Deal and/or Bumper Prize and the terms and conditions of the relevant third party shall apply in this regard. 

 

  1.  Quizkart reserves the right to modify the rules in this Policy regarding the Loot Deal and/or Bumper Prize on the Portal at any time.  

  

  1. User Conduct  
  1.  User shall not falsify his/her personal information (including, but not limited to, name, email address, bank account details and/or any other information) or documentation as may be requested by Quizkart to claim a Loot Deal and/or Bumper Prize. 

 

  1.  It is the responsibility of the User to read carefully and familiarise himself/herself with regard to the terms and conditions of the relevant third party with respect to the Loot Deal and/or Bumper Prize offered.   

 

  1.  Jurisdiction  
  1. The laws of India shall apply and courts in Bangalore in exclusion of any other courts shall have jurisdiction in respect of all the terms of this Policy. Quizkart reserves the right to make changes, amendment, addition, or deletion to the terms of the Policy at any time and without notice to you. For all matters related to or arising out of this Policy, the courts of Bangalore shall have exclusive jurisdiction. 
  1. Any disputes arising from this Policy will be settled in accordance with the provisions stated in the Terms and Conditions of Quizkart.  

 

  1. Grievance Redressal Mechanism
