REFUND POLICY

Fast Media Pvt Ltd. (herein referred to as “Quizkart”, “we”, “us”, “our”) hosts/operates campaigns on its website https://www.quizkart.com/ and through its mobile application (collectively referred to as “Portal”). This Refund Policy (“Policy”) is a part of the Terms and Conditions along with all the rules and regulations stated therein which shall apply to the Users (herein referred to as “you”, “your”) of the Portal. By registering or browsing or downloading or using or accessing any part of the Portal or utilizing the services rendered by Quizkart, you will be legally bound by this Policy. If you do not agree with any of the terms of the Policy, you can refrain from accessing or using the Portal. 

  1. Communications 
  1. When you use the Portal or send emails or other data, information, or communication to us, you agree and understand that you are communicating with us through electronic records and you consent to receive communications via electronic records from us periodically. We may communicate with you by SMS (including transactional, promotional, and/or commercial messages), email, or by such other mode of communication, electronic or otherwise.  

 

  1. Purchases and prizes  
  1.  User shall be offered coupons / vouchers /product reward/cash reward (“Loot Deal”) upon payment of the entry fee (“Campaign Participation Fee”) depending on the campaign chosen by the User with a subsequent opportunity to win the Bumper Prize associated with the relevant campaign. 

 

  1.  Once the Loot Deal is offered upon the payment of the Campaign Participation Fee, any request for cancellations or replacement of coupons duly placed on the Portal shall not be accepted. 

 

  1. The distribution of the Bumper Prize between the winners will be decided by Quizkart and may vary depending upon the campaign. The decision of Quizkart with respect to the awarding of Bumper Prizes shall be final, binding, non-negotiable and non-contestable. 

 

  1. All Loot Deals and/or Bumper Prizes shall be subject to deduction of tax as per the Income Tax Act 1961 and Goods and Services Act 2017 in accordance with the current prevailing rate (if applicable) on the Loot Deals and/or Bumper Prize and subject to further revisions by the Government of India as applicable from time to time. Winners will be provided certificates in respect of such tax deductions. The winners shall be responsible for payment of any other applicable taxes, including but not limited to, GST, income tax, gift tax, etc. in respect of the Loot Deals and/or Bumper Prize. 
  1. Third Party Service Provider 
  1.  Quizkart has entered into contracts and tied up with various brands and suppliers who will be responsible for delivery of Loot Deal and/or Bumper Prize. The terms and conditions of the relevant third party is applicable after verification of the Loot Deal and/or Bumper Prize claim by Quizkart.  

 

  1.  The User must understand the terms and conditions of the respective third party’s website with regard to the Loot Deal and/or Bumper Prize. Quizkart shall not be answerable for any claims arising out of such Loot Deal and/or Bumper Prize provided by the third party. 

 

  1.  User’s correspondence, transactions/offers or related activities with third parties including payment providers are solely between the User and the relevant third party providing such Loot Deal and/or Bumper Prize.  

 

  1.  Any questions, complaints, or claims related to any third-party product or service should be directed to the appropriate third party.  

 

  1. Refund  
  1.  Quizkart does not maintain any wallet function and no monetary withdrawals are possible on the platform once the Campaign Participation Fee is paid.  

 

  1. Once the Loot Deal is offered upon the payment of the Campaign Participation Fee, it cannot be substituted, exchanged, withdrawn, replaced or cancelled. Any request regarding the same by the Users, shall not be entertained by Quizkart.  

 

  1.  Quizkart disclaims responsibility and liability for any harm resulting from cancellation of any campaign(s) organized by it. The User will not be entitled to any refund or compensation in any form whatsoever, in case of any cause beyond the reasonable control of Quizkart. 

 

  1. Any Q Coins in your User account do not carry any interest or return. The Q Coins cannot be exchanged / redeemed for cash.  

 

  1.  Once the campaign has commenced, if the User has paused the play beyond the permitted time or is unable to play/resume the campaign(s) due to any technical issues with the hardware and software used by you or for any other reason, such inability to play shall not be a cause for claiming refund of the Campaign Participation Fee. 

 

  1.  We reserve the right to void your Campaign Participation Fee, or withhold or seize any or all of your Loot Deal and/or Bumper Prize in the event that we suspect you have breached terms and conditions and/or the privacy policy of Quizkart or if there is any ongoing investigation involving a suspected breach of these terms and conditions or any criminal, dishonest or fraudulent activity. 

 

  1.  All information regarding time frame for refund/return/replacement and processing of the same, mode of credit, other charges, cancellation, warranty and other details regarding the refund policy for the Loot Deal and/or Bumper Prize shall be in accordance with the terms and conditions of the relevant third party associated with the Loot Deal and/or Bumper Prize. Quizkart’s responsibility is only to the extent of verification of the Loot Deal and/or Bumper Prize claim by its Users. 

 

  1.  If it comes to the notice of Quizkart that any governmental, statutory or regulatory compliances or approvals are required for conducting any campaign(s) or if it comes to the notice of Quizkart that conduct of any such campaign(s) is prohibited, then Quizkart shall withdraw and / or cancel such campaign(s) without prior notice to any Users or winners of any campaign(s). Users agree not to make any claim in respect of such cancellation or withdrawal of the campaign and no refund would be given in this regard. 

 

  1. Disclaimer of Warranties and Liability 
  1.  On the Portal, all the services made available to you are provided on an “as is” and “as available” basis without any representation or warranties, express or implied except otherwise specified in writing by Quizkart. 

 

  1. Quizkart makes no representations or warranties as to the quality, suitability or merchantability of any Loot Deal and/or Bumper Prize and Quizkart shall not be liable for any refund or replacement on these grounds. 

 

  1. Quizkart may, at its sole and absolute discretion, vary or modify the Loot Deal and/or Bumper Prize being offered to winners. User shall not raise any monetary claim against Quizkart or question its right to modify such Loot Deal and/or Bumper Prize being offered, prior to closure of the campaign(s).  

 

  1. Quizkart accepts no liability, whether jointly or severally, for any errors or omissions, either on behalf of itself or third parties in relation to the Loot Deal and/or Bumper Prize. 

 

  1.  Loot Deal and/or Bumper Prize are generally intended for normal domestic and consumer use and not for resale or commercial use.  

 

  1.  Quizkart reserves the right to modify the rules in this Policy regarding the Loot Deal and/or Bumper Prize on the Portal at any time. 

 

  1. User Conduct  
  1.  User shall not falsify his/her personal information (including, but not limited to, name, email address, bank account details and/or any other information) or documentation as may be requested by Quizkart to claim a Loot Deal and/or Bumper Prize. 

 

  1.  It is the responsibility of the User to read carefully and familiarise himself/herself with regard to the terms and conditions of the relevant third party with respect to the Loot Deal and/or Bumper Prize offered.   

 

  1.  Jurisdiction  
  1. The laws of India shall apply and courts in Bangalore in exclusion of any other courts shall have jurisdiction in respect of all the terms of this Policy. Quizkart reserves the right to make changes, amendment, addition, or deletion to the terms of the Policy at any time and without notice to you. For all matters related to or arising out of this Policy, the courts of Bangalore shall have exclusive jurisdiction. 

 

  1. Any disputes arising from this Policy will be settled in accordance with the provisions stated in the Terms and Conditions of Quizkart.  

  

  1. Grievance Redressal Mechanism
